Fast Track Program Terms of Service:
Welcome to the Fast Track Program
This Terms of Service ("TOS") outlines the guidelines and requirements for participation in the Ecom Family Academy's ("EFA") Fast Track Program ("Program"). By enrolling in the Program, you agree to comply with these terms, which are legally binding. If you do not agree, please refrain from participating in the Program.
1. Program Overview
● The Program is designed to provide participants with an accelerated store-building service, including:
○ Phase 1: Store setup initiation and requirements gathering.
○ Phase 2: Store build and customization.
○ Phase 3: Store access and user onboarding.
○ Phase 4: Final ownership transfer and post-launch support.
2. Eligibility
● Participation is open to individuals 18 years or older.
● Program eligibility is subject to verification of account information and compliance with EFA’s standards.
3. User Responsibilities
● Collaborator Access: Users must submit the Shopify collaborator code via the Fast Track form to enable access for the store-building team.
● Platform Accounts: Users are required to create and provide login details for accounts necessary for store setup, such as CustomCat.
● Competitive Pricing Research: Students are solely responsible for conducting independent research to identify competitive pricing for their products. EFA’s pricing recommendations are based on current market trends, which may fluctuate according to product costs. However, EFA does not provide specific pricing guarantees.
● Communication: Participants are responsible for monitoring email communications and adding EFA emails to their contacts to ensure they receive all program updates.
4. Intellectual Property
● All assets provided by EFA, including logos, banners, and UGC creatives, are licensed for use within the Program. Ownership of these assets remains with EFA unless otherwise specified.
● The participant assumes ownership of the store once transferred and is responsible for all subsequent actions and modifications made to the store.
5. Program Services
● Store Setup and Design: EFA will provide a full store build, including print-on-demand (POD) products. The Program includes the upload of 15 POD products selected and designed by EFA.
● Coaching Calls: The Program includes three 30-minute coaching calls to address store management, marketing strategies, and operational advice. Students are responsible for scheduling these calls by contacting the Fast Track team at
fasttrack@ecomfamilyacademy.com.
○ Grace Period: Each call includes a 10-minute grace period. However, if you're more than 10 minutes late without prior notice, the call will be counted as completed.
○ Rescheduling: To reschedule a call, please email us at least 24 hours in advance at fasttrack@ecomfamilyacademy.com to avoid using one of your three sessions. Rescheduling with less than 24 hours' notice will count as one of your calls.
○ Call Recordings: All calls are recorded for quality assurance. After each call, you will receive a Zoom link to download the recording for your reference. ○ No-Show Policy: A no-show without documentation of an emergency (such as a hospital visit, car accident, or family loss) will count as a completed session. ● User-Generated Content (UGC) Creatives: Participants receive five UGC creatives to promote their products.
● Advertising Guidance: EFA provides insights on TikTok and Facebook ad setups, account warm-ups, and initial ad reviews. Users are responsible for implementing and monitoring these ads.
6. Post-Transfer Support
● 30-Day Support Window: After the store is transferred and accepted by the participant, EFA will offer modification support for a period of 30 days. During this time, EFA can assist with minor adjustments to ensure optimal store functionality.
● Extended Responsibility: Beyond the 30-day support window, any further modifications or maintenance are the sole responsibility of the participant.
7. Communication Policy
● Collaboration Code: If EFA does not receive responses from participants when requesting collaborator codes, EFA will continue to reach out for up to 1 year. Failure to respond and provide necessary information within this 1-year period will result in the student assuming full responsibility for initiating contact with EFA for any further assistance.
● Mandatory Ownership Acceptance: Upon store completion, participants are expected to promptly accept ownership of their Shopify store. EFA will continue to reach out for up to 1 year following the initial transfer notification. Failure to accept ownership within this timeframe releases EFA from any further obligation regarding the store, including maintenance, updates, or support. After the 1-year period, responsibility for contacting EFA and addressing any access issues rests solely with the participant.
8. Payment and Refund Policy
● Payment Terms: Payment for the Fast Track Program is due upon enrollment and is non-refundable once services begin.
● Refund Policy: Given the nature of the custom work provided, no refunds will be issued after the initial onboarding is completed, unless there is a breach of service from EFA.
9. Disclaimer of Warranties
● EFA provides all services in the Program "as-is" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of Liability
● EFA shall not be liable for any indirect, incidental, or consequential damages arising from participation in the Program. In no event shall EFA's liability exceed the amount paid for Program services.
11. Termination
● EFA reserves the right to terminate or suspend any participant’s enrollment in the Program for violations of these terms or if deemed necessary to protect the integrity of the Program.
12. Changes to Terms
● EFA reserves the right to amend these Terms of Service at any time. Any modifications will be communicated to participants and will take effect immediately upon posting.
13. Governing Law
● These Terms are governed by the laws of the United States and the applicable laws of the jurisdiction in which you reside. Any disputes arising from these Terms or the Program will be resolved through binding arbitration in your jurisdiction or another mutually agreed location, in accordance with the arbitration rules of the jurisdiction where the dispute arises.
